… Assistant U.S. Attorney Steven Durham: One of two prosecutors who worked on the original case last summer, which ended in a mistrial because prosecutors showed the jury inadmissible evidence, Durham is chief of the public corruption unit at the U.S. attorney’s office in Washington. He has directed a wide variety of white-collar prosecutions, including one against Riggs Bank that resulted in the largest criminal fine in the history of the Bank Secrecy Act. He also prosecuted baseball player Miguel Tejada, who pleaded guilty to a misdemeanour of misleading congressional investigators who questioned him about steroids.
— Assistant U.S. Attorney Daniel Butler: The other prosecutor from last year returning for the retrial, Butler specializes in fraud and public corruption cases and successfully prosecuted the case of “D.C. madam” Deborah Jeane Palfrey, who ran an escort service that catered to high profile clients including Sen. Explaining why he was calling a mistrial, the judge said, “Because if this man got convicted, from my perspective, knowing how I sentence, he goes to jail. And I’m not going to, under the circumstances, when this has happened, put this man’s liberty in jeopardy. He’s entitled to a fair trial; in my view, he can’t get it now. And that was caused by the government.”
Under U.S. sentencing guidelines, Clemens probably would face up to 15 months to 21 months in prison.
The prosecutors from last year’s trial, Steven Durham and Daniel Butler, are returning for the retrial.
Durham, chief of the public corruption unit at the U.S. attorney’s office, also prosecuted baseball player Miguel Tejada. In that case, Tejada pleaded guilty to a misdemeanor of misleading congressional investigators who questioned him about steroids. GREEN UP MARYLAND: Gov. Martin O’Malley aims to put Maryland on the map as one of the greenest states in the country, but given the $1 billion budget shortfall this year, some of his more ambitious energy plans might have to wait, Katherine Heerbrandt writes in the Gazette.
JUDICIAL PAY HIKE: The Senate passed a pay hike of up to $14,500 annually for Maryland’s 284 judges yesterday, citing an imperative to hire and keep talented legal minds on the bench, MarylandReporter’s Daniel Menefee writes.
REMOVE GUILTY OFFICIALS: Bills in the Maryland House and Senate would require elected officials at the state or county level to leave their post immediately after pleading guilty to felonies relating to their duties, Ben Giles reports in the Washington Examiner.
SERVICE TAX: Legislation that would add sales tax to everything from dating and escort services to car repairs and pest control has been introduced in the Maryland General Assembly, writes Matthew Bieniek for the Cumberland Times-News. The tax could increase state revenues by almost $300 million in the first year.

Extending Maryland’s 6 percent sales tax to businesses like tax preparation services, tanning salons and hair salons could net the state nearly $300 million next year, reports the Gazette.
Del. Sheila Hixson (D-Dist 20), who represents Silver Spring and parts of White Oak, along with Del. James Gilchrist (D-Dist. 17) want about 40 service-based businesses to share in the sales tax, which would help cover the $1.1 billion state budget gap.
According to the bill, cable television, auto repair, staffing companies, dating and escort services, notary publics, barbers and hair stylists along with public relations, consulting and management services would begin to be taxed.
Laura LaChappelle, president of a Joppla, MD public relations firm, told the Gazette:
“I could lose clients to competing firms in states that don’t have this tax. It’s not just smaller firms like mine, but big ones that are concerned.”

In a whistleblower notice filed with the city this month, Burton alleges the two-rank demotion to captain was punishment for testifying before the city council there was nothing inappropriate about the escort provided Sheen in April 2011.
Officers from the special operations division escorted Sheen from Dulles International Airport in northern Virginia to a stand-up performance at Constitution Hall in Washington.
The escort attracted wide media attention when Sheen posted on it on Twitter. According to a city inspector general’s report in July 2011, he tweeted: “n car with Police escort in front and rear! driving like someone’s about to deliver a baby! Cop car lights #Spinning!”
The former star of the TV series “Two and a Half Men” also posted a photo purportedly showing the speedometer of the SUV he was in reading about 80 mph, the report said.
BAD PUBLICITY CITED
The event’s promoter was billed $445.68 for the escort service, the report said. The unit’s duties include providing escorts for dignitaries visiting Washington.
